By accessing or using SafeLane ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and SafeLane ("we," "our," or "us").
2. Description of Service
SafeLane is a cloud-based school pickup queue management system designed to streamline student dismissal processes. The Service includes:
- Parent/guardian online registration and check-in
- QR code generation for contactless check-in
- Real-time pickup queue dashboard for school staff
- Administrative tools for school management
- Security features including device verification and PIN authentication
- Guardian authorization management
- Pickup history and reporting
3. User Accounts and Eligibility
3.1 Account Types:
- Parent/Guardian Accounts: Created by parents or legal guardians for pickup purposes
- Staff Accounts: Created by schools for authorized staff members
- Administrator Accounts: Created by schools for authorized administrators
3.2 Eligibility:
- You must be 18 years or older to create an account
- You must be a parent, legal guardian, or authorized school personnel
- You must provide accurate and complete information
3.3 Account Security:
- You are responsible for maintaining the confidentiality of your login credentials
- You must not share your account with others
- You must notify us immediately of any unauthorized use
- We are not liable for losses caused by unauthorized use of your account
4. User Responsibilities
4.1 Parents/Guardians Agree To:
- Provide accurate and current information about themselves, students, and vehicles
- Update information promptly when changes occur
- Keep their PIN confidential and secure
- Use the Service only for authorized student pickup
- Arrive at school when checked in or notify the school of delays
- Follow school pickup procedures and staff instructions
4.2 Schools Agree To:
- Verify parent/guardian authorization before granting access
- Train staff on proper use of the Service
- Follow school policies for student safety and release
- Maintain current contact information for families
- Promptly deactivate accounts for families no longer enrolled
- Ensure staff visually verify parent/guardian identity before student release
4.3 All Users Agree NOT To:
- Use the Service for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to the Service or other accounts
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) to access the Service
- Reverse engineer, decompile, or attempt to extract source code
- Transmit viruses, malware, or malicious code
- Impersonate another person or entity
- Harass, abuse, or harm other users or school personnel
5. School Responsibilities and Liability
⚠️ IMPORTANT NOTICE:
SafeLane is a tool to assist with pickup queue management. Schools remain solely and completely responsible for student safety and proper release to authorized individuals. SafeLane does not replace or supersede school policies, procedures, or legal obligations.
5.1 School Responsibilities:
- Verification: Visually verify parent/guardian identity before releasing students
- Authorization: Verify and maintain list of authorized pickup persons
- Custody Orders: Comply with all court orders regarding student custody and pickup restrictions
- Staff Training: Ensure staff understand SafeLane is a queue management tool, not an authorization system
- Emergency Procedures: Maintain backup procedures if the Service is unavailable
- Policy Compliance: Ensure SafeLane use complies with district and school policies
5.2 SafeLane is NOT Responsible For:
- Student release to unauthorized individuals
- Injuries or incidents occurring during pickup
- Custody disputes or violations of court orders
- Failure to verify identification
- Actions or decisions made by school staff
6. Service Availability and Modifications
6.1 Availability:
- We strive for 99.9% uptime but do not guarantee uninterrupted service
- Scheduled maintenance will be communicated in advance when possible
- We are not liable for service interruptions due to factors beyond our control (internet outages, natural disasters, etc.)
6.2 Service Modifications:
- We may modify, update, or discontinue features at any time
- We will provide reasonable notice of significant changes
- Continued use after changes constitutes acceptance
7. Data Ownership and Privacy
7.1 Data Ownership:
- Schools retain ownership of all data entered into SafeLane
- Upon termination, schools may request a full export of their data
- We may use aggregated, anonymized data for service improvement and analytics
7.2 Privacy:
Use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SafeLane, you agree to our collection and use of information as described in the Privacy Policy.
8. Payment Terms (For Schools)
8.1 Subscription:
- Subscription fees are billed monthly or annually in advance
- Fees are non-refundable except as required by law
- We may change fees with 30 days notice
- Schools may cancel at any time with 30 days written notice
8.2 Late Payment:
- Accounts more than 15 days past due may be suspended
- Access will be restored upon receipt of payment
- Late fees may apply as permitted by law
8.3 Free Trials:
- Free trial periods (if offered) are subject to these Terms
- We may require payment information before trial begins
- Subscription begins automatically after trial unless cancelled
9. Intellectual Property
9.1 Our Rights:
SafeLane and all related content (software, design, text, graphics, logos) are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or create derivative works
- Reverse engineer or decompile the Service
- Remove copyright or proprietary notices
- Use our trademarks without written permission
9.2 License:
We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. This license terminates upon account termination or violation of these Terms.
10. Limitation of Liability
IMPORTANT LEGAL NOTICE:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFELANE SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL
- ANY DAMAGES ARISING FROM USE OR INABILITY TO USE THE SERVICE
- ANY ACTIONS TAKEN BY SCHOOLS, STAFF, OR OTHER USERS
- ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF DATA
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU (IF A SCHOOL) IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless SafeLane, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any actions taken by your school staff using the Service
- Any student release decisions made by your school
12. Termination
12.1 By You:
- Parents/guardians may request account deactivation through their school
- Schools may cancel their subscription with 30 days written notice
12.2 By Us:
We may suspend or terminate your access immediately for:
- Violation of these Terms
- Non-payment (for schools)
- Fraudulent, abusive, or illegal activity
- Security concerns
- At our discretion with 30 days notice (for schools in good standing)
12.3 Effect of Termination:
- Your right to use the Service immediately ceases
- Schools may request data export within 30 days
- We may delete your data after the retention period (see Privacy Policy)
- Provisions that should survive termination (liability limitations, indemnification) will continue to apply
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
- ACCURACY, RELIABILITY, OR CORRECTNESS OF INFORMATION
We do not warrant that the Service will meet your requirements or that any errors will be corrected.
14. Dispute Resolution
14.1 Informal Resolution:
Before filing a legal claim, you agree to contact us at support@justautomate.info to attempt to resolve the dispute informally.
14.2 Arbitration:
If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except as permitted by law. Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
14.3 Class Action Waiver:
You agree that disputes must be brought on an individual basis only, and may not be brought as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
15. Governing Law
These Terms are governed by the laws of Georgia, United States, without regard to conflict of law principles. Any legal action must be brought in the state or federal courts located in Henry County, Georgia.
16. General Provisions
16.1 Entire Agreement:
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SafeLane.
16.2 Amendments:
We may modify these Terms at any time. Material changes will be notified via email to schools. Continued use after changes constitutes acceptance.
16.3 Severability:
If any provision is found unenforceable, the remaining provisions will continue in full effect.
16.4 No Waiver:
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
16.5 Assignment:
You may not assign these Terms without our written consent. We may assign these Terms without notice.
16.6 Force Majeure:
We are not liable for failure to perform due to circumstances beyond our reasonable control (natural disasters, war, terrorism, riots, internet failures, government actions, etc.).
